I allow my website to be scanned and the data regarding the contents of it to be stored and displayed by the search engines of Google.com, Bing.com, and DuckDuckGo.com only. The actions of these search engine companies are mutually beneficial to them and to me. Other than the web bots of these three USA-based companies, only real humans using a browser are allowed to access my website. I forbid all access by Yandex in Russia, Baidu in China, and any other search engines not based in the USA. I deliver my photography products only to addresses in the USA, so letting these foreign companies use my servers and resources to scan and index my website is of little value to me and results in unnecessary expense for me and possible access difficulties for my human visitors.

I specifically prohibit any website development, hosting or SEO company, or any sales or marketing company from using their web spiders, crawlers, or robots ("bots") to scan or scrape my web pages and store my data for the purpose of providing information and advice to their customers or anything else without giving compensation or consideration to me. The text, photos, graphics, programming code, design, layout, and all other aspects of my website are copyrighted by me and are my personal intellectual property which may not be used without my express permission. I also have to pay for the web servers which host my website and display it on the Internet. When the bots of these companies scrape my website, it requires time on my servers to respond to their requests. This is a real cost to me, as well as potentially preventing my valid visitors from getting to see my site quickly or at all. Consequently, I am willing to allow access to this type of bot only if I am paid a usage fee of $1.00 per page, or a one-time fee of $2000.00 total, by the company who operates the bot. Scanning a total of 10 pages or more of my site indicates implied consent and agreement to these terms. I record all page requests and automatically will submit a weekly invoice for these fees to any such company whose bot or bots continue to scan or scrape any page or part my website.

Payment of these service fees for data usage does not include the granting of any rights to display, reproduce, revise, create derivative works from, transfer, license, distribute, rent, sell or re-sell my photos, either individually or as a collection of any size, in any media, whether electronic or physical.

Acceptance of Terms Through Use

Having your web spider, crawler, or robot scan or scrape TygerGilbert.com for the purposes of providing website development, web hosting, or SEO information or services, or for use in any type of direct sales or marketing, is considered a use of this website which requires compensation to me. By continuing to have your bot or bots scan or scrape any part of my site, YOU ACKNOWLEDGE THAT YOU HAVE READ AND AGREE TO THESE TERMS and will pay my fees. This is a legal, binding contract. If you do not agree, stop using my site and remove all data on your servers related to it.

I may revise this Agreement at any time by posting the amended Terms of Use by Web Bots on this website and by providing a 7-Day written notice to you in my invoices. By continuing to allow your bot or bots to scan or scrape any part of my site after this notice, you affirm that you agree to these changes. I will also post notice of these changes with links to them at the bottom of most pages. For your convenience, the date of last revision is shown at the top of this page.

Payment of my invoices will be due upon presentation and will become past due if not paid within seven (7) days. Past due amounts will accrue interest at a rate of 2.5% per week, compounded weekly.

Prosecution for your continued scanning or scraping of my website without payment may involve penalties provided by the Computer Fraud and Abuse Act (CFAA) enacted in 1986 and revised in 2008, the Digital Millennium Copyright Act (DMCA) enacted in 1998 related to United States copyright law that uses 1996 treaties of the World Intellectual Property Organization (WIPO), and any other laws that are meant to protect against copyright infringement or accessing a computer to obtain information without permission of the owner of the data, as well as debt collection laws.
